A federal judge has ruled that a drug manufacturer, Pfizer Inc., could be required to stop selling Viagra after a hearing in a federal judge in Quebec has begun.
The decision by Quebec Superior Court judge Paul Moulmein goes into full detail and says that Pfizer did not intend to promote Viagra for sexual use, although Viagra sales in Canada are often cited for it.
Pfizer’s patent covering Viagra (sildenafil citrate) was granted in Canada in 2003. The patent has now expired, but it is the first time a Canadian patent has been allowed in the United States.
The decision follows a case in which Pfizer argued that the company had not been able to establish that Viagra was safe to sell. A trial in Quebec in October 2002 found that Pfizer had not had an adequate warning of the risk of erectile dysfunction. The company appealed that decision, and the Supreme Court of Canada ruled on November 5, 2002 that it was entitled to a new trial.
The plaintiff’s lawyer is now asking the Supreme Court to overturn the lower court ruling and order Pfizer to immediately cease selling Viagra.
The drug manufacturer, Pfizer Inc., has already agreed to continue selling the drug in Canada. The drug manufacturer will be required to pay a fine of up to $3.4 billion, the amount it may have to pay to settle a lawsuit alleging that Pfizer had marketed it for the purpose of selling impotence. The lawsuit claims that Viagra was the cause of the deaths of three men who had taken the drug.
The plaintiff has not yet been appointed as a plaintiff in the case and, instead, has filed an appeal.
The case was heard on November 20, 2002 by Judge James D. Macrige of the Supreme Court of Canada.
The plaintiff’s lawyer is currently seeking a second trial on the issue of liability for Viagra.
